26.07.2005 - EC Amendments to the CTM & Fees Regulations Enter into Force Today ALICANTE, SPAIN - The Office for Harmonization in the Internal Market (OHIM) announced on Monday that the regulation implementing the Community Trademark (CTM) Regulation, and the amendments to the regulations on fees payable to the OHIM, which were adopted by the European Commission (EC), enter into force on July 25, 2005.
A press release issued by OHIM stated that the amendments to these regulations, adopted by the EC on June 29, 2005, must be seen in the context of the amendments to the community trademark regulation made by the EC Council.
Some of those amendments entered into force immediately. Several amendments concerning the organization of, and procedures before, the Boards of Appeal of OHIM Office required changes to the Rules of Procedure of the Boards of Appeal.
A number of other amendments brought about by Regulation No 422/2004 required implementing rules and are only now coming into force together with the recent amendments to implementing the CTM and the fees regulations.
The recent amendments to the implementing regulation go beyond merely implementing Regulation No 422/2004 and contain a number of other procedural improvements. This is in order to simplify the proceedings, remove doubts and pitfalls, and to benefit from the OHIM’s nine years of experience in applying the CTM Regulation.
